Regulatory & Operational Matters

With the health care industry being heavily regulated, Baker & Daniels’ professionals routinely advise clients on a wide variety of regulatory matters, including licensing, Medicare and Medicaid certification and reimbursement, compliance with Medicare and Medicaid fraud, FDA issues, abuse and anti-dumping laws, and compliance with antitrust laws. Issues often involve dealing with the Indiana State Department of Health, Family and Social Services Administration, Department of Health and Human Services, Office of Inspector General, Food and Drug Administration, Department of Justice, Internal Revenue Service, Center for Medicare and Medicaid Services, Federal Trade Commission and other state and federal agencies.

Our health care professionals also advise clients on issues relating to the Medicare and Medicaid Fraud and Abuse laws and other anti-referral rules. In addition, we counsel clients on compliance with the accreditation standards of non-governmental accreditation bodies, including the Joint Commission on Accreditation of Health Care Organizations. We also advise clients on operational issues relating to medical staff relations, physician recruiting and retention, third-party reimbursement, retention and release of medical records, including HIPAA compliance, informed consent, advance directives, substituted consent and withdrawal of life support.
